The Phorm fall out

The recent media frenzy surround the ad-tracking system called Phorm has highlighted some important questions regarding the legality of "opt-out" services.

Guidance from the Information Commissioner, Britain’s data protection watchdog, seems to suggest that an online service should only be offered to the public on an “opt-in” basis, otherwise the site in question may find itself on the wrong side of something called PECR.

Whilst the experts battle it out and provide the rest of us with some clarity on the issue, from today onwards, we shall protect the interests of our clients by offering opt-in services as default.

Our clients can explicitly request “opt-out” services where they feel appropriate, but we will in the meantime advise against this practice.
